ARAKUNRIN OLUWAROTIMI AKEREDOLU (SAN)
RE: THE CONTINUOUS SILENCE ON THE ALALE OF AKUNGBA CHIEFTAINCY
Dear Mr. Governor Sir,
We write to you with due respect and inestimable concern for your office and personality
Mr Governor, we rejoice with you on your one year in offices, it’s a bit a year in office now, that you been so kind to the good citizen of Ondo state, you have shown to us that you are the right candidate to rule this prestigious state of ours, and we pray that God will direct you to lead us in his will, more grace
Your Excellency, we felt it would be most perfidious if we fail to draw your attention to this issue on the Alale of Akungba Chieftaincy.
This letter should come to you as a product of state obligation, since to be silent in the face of our state throes is itself a wing of corruption punishable by a good conscience, in the crux of this open letter, please bear with us for reaching you via this means.
We know, it is your Joy and happiness that all the town and communities in Ondo state are in peace including Akungba Akoko which is one of the university communities in Ondo State. But we want you to know that the peace you thought is reigning in Akungba is at the detriment of some people who are anxious and well concern on the development of Akungba and her diaspora as a result of the Injustice act committed by the past Government of Ondo state at the eve of his departure from office.
His Excellency, The three arms of government are the Executives, the Legislative and the Judiciary, these arms of Government work together to sees and ensures Justice is well practices in the Country.
Mr. Governor Sir, it has come to our notice that the copy of the Judgment delivered from The High Court of Justices and that of The Court of Appeal of Nigeria, by Hon. Justices B.F Adeyeye and Hon. Justices Mohammed A. Danjuma (JCA) respectively had gotten to your precious office.
You will note from Page 30&31 of the High Court Judgment which says:-
“The meeting which produce the Isiaka Oseni is from the circumstance of this case yet to be approved by the 8th defendant {The Governor Ondo State} who still has statutory powers to exercise to approve or do disapproved the selection of the Kingmakers.
The counterclaim succeeds. It is made out. Consequently, I grant the reliefs of the counterclaimant and I therefore make the following order:-
A declaration that Ole Ruling House of Alale of Akungba Akoko comprises of the three branches namely: AGURE, MOKUN and AJIKE and all are entitled to and/or eligible to present candidates to the stool of Alale of Akungba.
A declaration that it is wrongful and Unlawful to restrict the meeting of Ole ruling House of Alale of Akungba Chieftaincy in Akungba Akoko for the purpose of nominating candidates for Alale of Akungba Stool for presentation to the kingmakers to the Ajike Branch of Ole Ruling House alone.
A declaration that both Agure Mokun branches of Ole Ruling House are entitled to be invited and attend the meeting of Ole Ruling House for purpose of nominating candidates for the filling of Alale of Akungba Chieftancy in Akungba Akoko.
A declaration that the selection of Prince Isiaka Oseni by the kingmakers is VALID.
An Order of Court restraining the 3rd to 8th defendants {Chief Akin Ologunorisa, High Chief Jacob Oluwabori Adedayo, Secretary ASWLG, Chairman ASWLG, The Attorney General and Commissioner for Justice Ondo State, The Governor, Ondo State.} from acting on any list {Ajimoh Rowland, Ajimoh Rasheed-(2nd Plaintiff), Lasisi Gasali, and Sunday Isaac Ajimoh} presented by 1st Plaintiff {Prince Julius Agboola Olanipon} who has been found not to be the head of the Ole ruling House, to the 3rd and 4th defendant or the kingmakers for Alale of Akungba Chieftaincy.
Your Excellency, it was known to us that the claimant put forward an appeal against these Judgment listed above, in which the Appeal was dismissed at the Court of Appeal of Nigeria, by Hon. Justice Mohammed A. Danjuma, (JCA) and Affirmed the Judgment of the High Court, which was delivered by Hon. Justice B.F Adeyeye.
Furthermore, while the appeal was pending, the appellants in connivance with the immediate past government of Ondo State at the eve of his departure from office, he appointed One Prince Sunday Isaac Ajimoh as the Alale of Akungba without waiting for the outcome of the appeal, in which we all know this act as an opprobrium to the Judiciary Body and also A contempt of Court considering Judgment Order number five (5).
Mr. Governor Sir, Please prove to the entire Ondo state Indigene that you are truly for everyone and not for anyone, by personally looking into the Alale of Akungba Chieftaincy and intervene immediately in this matter, to correct the Injustice and gross abuse of Court process.
We pray for God wisdom upon you to handle this matter.
